Terms of Service

These Terms govern your use of MarkPilot (the “Service”) at trymarkpilot.com. By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service. These Terms are an agreement between you and Brilliant Minds Global Private Limited, the company that operates MarkPilot (GSTIN 08AAOCB3511G1ZT).

1. The Service

MarkPilot is an AI marketing platform that generates content and, at your direction, publishes it to the social media accounts you connect. Features and plans may change over time.

2. Eligibility & accounts

You must be at least 18 and able to enter a binding contract. You’re responsible for your account, your credentials, and all activity under your workspace. Keep your login secure.

3. Your content & the publishing authorization

• You retain ownership of the brand information, prompts, and content you provide.
• You grant MarkPilot the permissions needed to generate, store, brand-check, and publish content on your behalf to the accounts you connect, using the autonomy settings you choose.
• You are responsible for the content that is published from your account — including content generated by the AI and posted automatically — and for ensuring you have the rights to use it.
• You can set agents to require your approval, or run them autonomously; you control this at any time.

4. Acceptable use

You agree not to use MarkPilot to create or publish content that is illegal, deceptive, infringing, hateful, spammy, or that violates the rules of any connected platform (including the Meta Platform Terms, Instagram policies, and the X rules). You won’t misuse, reverse-engineer, or disrupt the Service.

5. AI output

AI-generated content can be inaccurate or imperfect. MarkPilot provides brand-safety checks, but you are responsible for reviewing and approving content as appropriate before it represents your business. We make no guarantee about the accuracy or fitness of generated content.

6. AI-content disclosure

Content created with MarkPilot is generated, in whole or in part, by AI. Some platforms and laws require that AI-generated or AI-assisted content be labelled as such. MarkPilot does not automatically add AI-disclosure labels to your posts, so you are responsible for disclosing AI-generated content where the connected platform’s policy or applicable law requires it (for example, platform “made with AI” or synthetic-media labels). You agree to comply with those disclosure rules for content you publish through the Service.

7. Plans, billing & credits

• Paid plans are billed monthly in advance in INR by direct UPI, confirmed manually before your plan is activated. A payment gives 30 days of access and does not auto-renew; to continue, you pay again for the next period. 18% GST is invoiced separately as required by law.
• Usage is metered in credits as described in-app. Credits and plan limits are shown before you incur cost.
• Because payments don’t auto-renew, you simply stop paying to discontinue; access continues through the period you’ve already paid for. Fees are non-refundable except where required by law — see our Refund & Cancellation Policy.

8. Third-party services

The Service relies on third parties (social platforms, AI, hosting, and payment providers). Your use of connected platforms is also governed by their terms, and we’re not responsible for their acts or changes to their APIs.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind to the extent permitted by law. We don’t warrant uninterrupted or error-free operation.

10. Limitation of liability

To the maximum extent permitted by law, MarkPilot is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.

11. Termination

You can stop using the Service and delete your account anytime. We may suspend or terminate access for breach of these Terms or misuse. On termination, your right to use the Service ends; data handling follows our Privacy Policy.

12. Changes

We may update these Terms; we’ll post the new version here and update the date. Continued use means you accept the changes.

13. Governing law

These Terms are governed by the laws of India, and disputes are subject to the courts of India.
